Navigating Childhood Sexual Abuse Cases in 2024

This panel will discuss the landmark CSAA amendments from legislator’s perspective, TCA, CSAA, Charitable Immunity. A panel of experienced practitioners will discuss all aspect of handling a sex abuse case, including retainer agreements, discovery issues (requesting reservation of rights letters, deposing victims, obtaining records from DCPP with motions for a court order), need for insurance archaeologist for coverage in old cases, insurance coverage and declaratory judgment actions, RPCs and duty to represent the defendant not the carrier, what to do when there is bad faith, drafting jury charges on the liability and damages (punitive and attorney’s fees) under the CSAA and LAD. It will also examine representing nonprofit and other organizations – when are policies needed, sample policies, coverage issues for past acts, background checks for employees, the Diana Screen.CLE Credits For This Program:
